An open letter to the Attorney General of the State of California
There is a current Children Protective Service (CPS) case in Sacramento involving Alex and Anna Nikolayev and their 5-month-old baby Sammy.
The Nikolayev family took Sammy to the hospital for flu like symptoms. Sammy also has a heart murmur and has been monitored by a doctor since he was born. The hospital treated the baby for the flu symptoms but kept him for observation. The doctors had recommended an immediate heart operation.
The parents wanted a second opinion so they took the baby from the hospital to another hospital. The second doctor said the baby was clinically safe to go home with his parents. The doctor added, “I do not have concern for the safety of the child at home with his parents.” The police came to their home that same day. They checked the baby and he was OK. The police personnel said the initial hospital had told them so many negative things that they thought the baby was dying. The police saw this report from the second doctor and said OK then left. The next day the police and child protective services showed up on their doorstep. They entered the home without a warrant and forcibly took the baby.
The CPS social worker told her, the reason they took Sammy is because of severe neglect; however, the social worker didn’t elaborate on that neglect.
The California State Assembly is doing an audit into the CPS.
I am asking the Attorney General to conduct a thorough investigation of the social worker, the hospital and their standard of care. I would also like to know why the police department didn’t use the information from the up-to-date doctors report to stop this removal.
While we are relieved to hear that justice has finally prevailed, what is being done to ensure that this doesn’t happen again? And furthermore, what will ever become of the investigation as to why this happened at all? CPS was started for the right reason. But since money is involved in the system, it seems that more children are removed for no just cause. It’s time to revamp CPS.
It appears that parents have no rights in the state of California. It is a heartbreaking story. It is an outrage what is being done to this family.
